Tetlow King Planning (TKP) assisted Cotswold Homes in securing planning consent for the redevelopment of a factory site to provide 10 high quality homes within the Broughton Gifford Conservation Area in Wiltshire.
TKP were also able to secure planning consent for the change of use of a building within the Bowerhill Principal Employment Area for the existing owners of the factory in Broughton Gifford to relocate their business to. The factory owners new site in Bowerhill had the added benefit of being more sustainable than their previous site in Broughton Gifford as it enabled staff to use public transport to travel to work, in addition to which the move also enabled the company to be located closer to their subcontractors and suppliers who they deal with on a day to day basis.
We demonstrated that there was in fact no loss of employment land due to the relocation of the factory owner to a vacant site and as such no marketing of the site needed to be demonstrated in order for consent to be granted for its redevelopment for residential use.
In November 2014 the Government released a Written Ministerial Statement (WMS) which set out that schemes of 10 dwellings or less should not be subject to contributions for affordable housing and tariff style planning obligations. Despite Core Policy 43 of the Wiltshire Core Strategy requiring schemes of 5 or more dwellings to provide towards affordable housing, TKP were able to successfully argue that the WMS should carry greater weight and the consented scheme was not subject to such obligations.
