Third Party Representations Count in West Malling

Tetlow King Planning (TKP) submitted representations to Tonbridge and Malling Borough Council on behalf of clients to a proposal adjoining their property in West Malling, Kent. The property was a Listed Building and located in a Conservation Area, it adjoined a terrace of houses one of which was our clients, who shared a common boundary with the application site.

The planning application proposed a side extension along the adjoining wall to the neighbouring property. The Client was concerned of loss of light and outlook, along with the issue that they would not be able to open an existing window fully because of the proposed extension.  TKP also argued that the proposed extension would harm the setting of the listed building and the character of the Conservation Area.

Following submission of the representations to the local planning authority, the application was reported to Committee, with a recommendation from the officer to approve. Following consideration of our representations, members of the Planning Committee deferred the application to carry out a site visit. Following the site visit, at the next committee members agreed with our representations and decided to refuse the application because of the overall detrimental harm on the character of the area which they considered harmful to the character and appearance of the Conservation Area and to the setting of Listed Buildings.
